1. About these Terms

These Terms of Service ("Terms") apply to your use of the My Boat Prep app and website at myboatprep.com (the "App"), provided by the team at My Boat Prep ("My Boat Prep", "we", "us").

By creating an account, signing in or using the App you agree to these Terms. If you do not agree, do not use the App.

2. Emergency services disclaimer

The App is NOT a replacement for official maritime safety equipment, including a marine VHF radio, an EPIRB or PLB, flares, lifejackets, a liferaft or any other safety gear required by law or good seamanship.

The App is NOT a replacement for professional training, recognised boating or radio operator qualifications, official charts, weather forecasts, local notices or instructions from maritime authorities, coastguard or rescue services.

The App does not contact emergency services. In an emergency, use your VHF radio (Channel 16), EPIRB/PLB, flares or phone to call for help directly.

3. Mayday and Pan-Pan scripts are a reference tool only

The Mayday and Pan-Pan scripts, checklists, Skipper's Tips, FAQ and all other content in the App are general reference material only. They are provided "as is" and "as available".

Radio procedures, legal requirements and best practice differ between countries, jurisdictions, waters and vessel types, and can change. We make no warranty or representation that any text in the App is accurate, complete, up to date or suitable for your situation, jurisdiction, waters or vessel.

Information filled in automatically (such as vessel name, callsign, date and GPS position) depends on what you enter and on your device. GPS positions may be inaccurate, out of date or unavailable.

4. No warranties

To the fullest extent permitted by law, we disclaim all warranties, conditions and guarantees, whether express or implied, including any implied warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose and non-infringement.

We do not promise that the App will work without interruption or errors, that it will work offline or sync in every circumstance, or that your data will never be lost. Keep printed copies of important lists on board.

5. Limitation of liability

To the fullest extent permitted by law, My Boat Prep and its team, owners, contributors and suppliers are not liable for any injury, illness, loss of life, damage to or loss of any vessel or property, environmental damage, fines, or any direct, indirect, incidental, special or consequential loss, arising from or connected with the use, misuse, inability to use or failure of the App, including during an emergency.

This applies however the loss arises, including in contract, tort (including negligence), breach of statutory duty or otherwise, even if we were told the loss was possible.

Where liability cannot be excluded by law, our total liability to you is limited to the amount you paid us for the App in the 12 months before the claim, or NZD 10 if you have not paid anything.

Nothing in these Terms limits any rights you have under consumer protection laws that cannot lawfully be excluded.

6. The Skipper's responsibility

The skipper or captain of the vessel is solely responsible for the safety of the vessel and everyone on board, for safe navigation, and for calling for help in the right way when needed.

Before relying on any checklist or script, the skipper must check that it is correct and complete for their vessel, crew, waters and local rules, and must edit or add to it as needed. Ticking the Skipper's check box on the Mayday and Pan-Pan lists is your confirmation that you have done this.

You use the App at your own risk and must always use your own judgement and seamanship.

7. Accounts, plans and payments

You are responsible for keeping your sign-in details secure and for everything done through your account.

The Free plan is supported by ads and has some limits. The Pro plan is a yearly subscription (currently NZD 49.99 per year, with launch offers such as FIRST5000 shown at checkout) paid securely through Stripe. Pro renews each year until you cancel; if you cancel, Pro stays active until the end of the period you have paid for. We may change plans and prices for future renewal periods with notice in the App.

We may suspend or close accounts that misuse the App or break these Terms.

8. Your content and data

Your checklists, Ship's Logs and boat details are stored on your device and backed up to our cloud service when you are online. When you email a PDF, it is sent to the addresses you choose and a copy is kept so the download link works.

You own the content you add. You give us permission to store and process it only so we can run the App for you.

9. Third-party links and services

The App links to third-party websites and services, such as YouTube channels, movie pages, Google sign-in, Stripe and advertising. We do not control them and are not responsible for their content, availability or terms.

10. Changes to these Terms

We may update these Terms from time to time. If we make important changes, we will ask you to accept the new Terms in the App. Continuing to use the App after accepting means you agree to the updated Terms.
